Terms and conditions
This is a draft version. The terms and conditions will be finalized before the paid service launches.
1. Who are we?
marcai.eu is a service of Point2Create BV, Chamber of Commerce 63324547. These terms and conditions apply to any use of the website and the service.
2. What we provide — and what we do not
We provide information on trade mark law and, if you choose, preparatory work for a trade mark application: a conflict search, a class advice and a prepared application. This is expressly not legal advice and we do not act as a trade mark representative: no advisory relationship is created, and we give no guarantee that your trade mark will be registered. The Office decides on that, and it may refuse a trade mark on grounds that are not visible in any register.
You must file the application yourself via your own account with the BOIP or the EUIPO, so that the trade mark is registered in your name; you pay the fee directly to that Office. If there is a refusal or an opposition, we will, at your request, transfer the file to a trade mark representative. Conducting that procedure is outside our service provision.
3. Due diligence and errors
We endeavour to present information accurately, up to date and with source attribution, and we review every text before publication. However, legislation and its interpretation change; completeness or accuracy cannot therefore be guaranteed. If you spot an error, please report it — we will update the text or remove it from our site.
4. Subscription and payment
The subscription runs per month or per year and is cancellable at the end of the term. All prices are exclusive of VAT. For business customers outside the Netherlands with a valid VAT identification number, VAT is reversed.
5. Use of content
The texts on this platform are protected by copyright. Automated and large-scale copying (scraping) or commercial reuse is not permitted without written consent. The trade mark registers themselves are public and remain freely accessible via the BOIP, the EUIPO and TMview.
6. Liability
We are not liable for damage arising from decisions you make based on the information provided, nor for indirect damage or circumstances beyond our reasonable control. Nothing in these terms and conditions limits liability that cannot be excluded under mandatory law, including liability for intent or gross negligence.
7. Applicable law
Dutch law applies to these terms and conditions. If you have a complaint, please let us know first via office@marcai.eu; if we cannot resolve it together, you may refer the matter to the competent Dutch court.
