marcai.eu: who we are and how we work
marcai.eu helps entrepreneurs register their name as a trade mark. Not for lawyers — for the entrepreneur who wants to know whether his name is still available, what it costs and what exactly he needs to file.
Why this platform exists
Registering a trade mark is not a complicated form. The difficult part lies in two questions you can answer wrongly without noticing: does my name too closely resemble something already registered, and in which classes should my trade mark apply? The first question leads to oppositions, the second to refusals — and in both cases you lose the fee.
A trade mark attorney will work that out for you and charge an hourly rate. We do the same preparatory work for a fixed fee, and you then file yourself via your own account at the office. What you end up with is the same trade mark, in the same register.
How the texts are created
We work from the public trade mark registers: that of the BOIP for the Benelux, that of the EUIPO for Union trade marks, and TMview which brings together the European offices. In addition, the Nice Classification from WIPO for the classes. These are the same sources a trade mark attorney consults, and we state on each page which ones we have consulted and when.
The texts are written with AI based on those sources, put through a technical review that blocks prohibited formulations, and then approved by a human before they go online. Nothing goes live automatically. Under each article is shown when it was last reviewed.
What we do not do
We are not a trade mark attorney and do not provide legal advice. We do not promise a guarantee anywhere, because nobody can: an office can refuse a trade mark because it is too descriptive, and that is not in any register. And we do not state any fee or deadline that we cannot point to at the office itself.
If an opposition is pending or a refusal comes in, we hand the file over to a trade mark attorney. We do not handle those matters ourselves, and we say so in advance rather than afterwards.
